Criminal Attorney With Experience In Conditional Record Sealing Cases

Is a criminal conviction holding you back? If so, a conditional sealing may be an option that can help you get your life on track. There are very specific circumstances where a conditional sealing can help, and a strict list of criteria that you must meet to qualify. To ensure that you do everything right, you should have the guidance of an experienced criminal defense attorney. On the other hand, I have seen circumstances where a conviction of a violation charge or even a dismissal of a charge should have been sealed, and an administrative error caused that conviction or dismissal to remain open for the public to see. You can fix that error.

I, Luke Scardigno, have spent more than 25 years providing personal attention and custom-tailored legal advice to clients in Queens and throughout New York. I can help you determine if you qualify for a conditional sealing, and, if you do, what steps you need to take. I strive to be both a trusted adviser and a powerful advocate for you, so you always know where to turn for help with a sealing of criminal convictions, or any other criminal defense needs.

Conditional Sealing In New York

In New York state, there are sealing laws under sections 160.50, 160.55, 160.58 and 720.35 of the New York Penal Law. Sealing of a criminal or a violation conviction, or of an arrest charge that has been dismissed, prevents the majority of the general population from being able to view certain charges and convictions in your criminal history. Call me to discuss each one and how it may apply to your circumstances.

Conditional sealing under New York Penal Law section 160.58 is possible for crimes such as burglary, criminal possession of stolen property, grand larceny, criminal mischief, drug charges and possession of a forged instrument. The specific circumstances of your case will ultimately determine if such a sealing is applicable to your case. You need an advocate who knows how to shape a persuasive argument based on your situation.

Successfully obtaining a sealing can help when you attempt to secure:

  • Employment
  • Housing
  • Funds for school
  • Other services that require a background check

The sealing process can be very complicated. Because I practice only in the area of criminal law, I am well-versed in this procedure — I have helped many clients seal their records and improve their lives.
