A criminal case against against Juerys Familia, a pitcher for the New York Mets, was dismissed last week in New York Municipal Court. The judge presiding over the matter dismissed the matter with a Code 6, signifying that there was a lack of prosecution. The baseball player's record will now be expunged.
According to the prosecuting attorney, after speaking with the Major League Baseball player's wife and reviewing the matter, he felt that it should be dismissed. He further claimed that the arresting was in agreement. According to the attorney for the player, they were happy with the result.
The assault allegations and charges originated from an incident that happened during Halloween. According to court papers, it was claimed that Jeurys Familia physically hurt another person through an act of domestic violence.
According to police, they found that the victim had been scratched and the right cheek of the victim was bruised. Police had arrived to find the victim after she called police to say that Familia, her husband, was drunk and going crazy.
Familia is known to have been a public advocate against domestic violence. In a campaign created by the National Coalition Against Domestic Violence, Familia recorded a video against domestic violence and domestic abuse. Although the video once appeared on the organization's website, following his arrest, it was no longer found available on the site.
Domestic violence charges can have immediate and serious consequences for one's life, reputation, friendships, romances and careers. These consequences will likely happen even before a conviction occurs. However, with the help of a criminal defense attorney, those accused of domestic violence in New York can seek to try and get their charges dropped and/or reduce their punishments in the event of conviction.
