Quality Representation Following A Criminal Trucking Violation
Last updated on March 15, 2024
At the Law Office of Luke Scardigno, I represent truckers and professional drivers facing charges that could impact your ability to do your job. I have been doing this for more than 30 years. You can count on me to fight for your rights throughout the entire criminal process.
The Kinds Of Violations You May Face As A Trucker
Today, New York City police officers are being trained to pull over commercial truck vehicles and issue various types of violations or infractions for either defective equipment, lack of stickers or DOT numbers, and other types of violations, such as:
- Defective air or leaking air brakes
- Axle defects
- Defective hoses
- Defective brake or other lights on trucks
- Incorrect or missing DOT number
- Defective or worn-out tires
- Defective exhaust system
- And other equipment defects such as horns and turn signals
These violations or infractions are commonly now issued through the use of a pink summons, which is answerable in the criminal court located at 125-01 Queens Boulevard, Kew Gardens, New York. However, these pink summonses are answerable across the street in a special court part called AR2 or SAP. The address where these pink summonses are answerable is located at 120-55 Queens Boulevard, Kew Gardens, New York 11415. The entrance for this court part is on the side of the building, not the front of the building.
Do Not Ignore A Summons
One thing you should not do, even though the pink summons is in the corporation name, is ignore the summons. An experienced criminal attorney will be able to assist you and have most, if not, all of the summonses dismissed if you provide proof of repairs or obtaining the proper certificates or stickers prior to the court date.
If the summons is for defective equipment and other alleged violations against the vehicle itself, not the driver, the summons will be issued to the corporation name. If it is an alleged traffic violation that the driver committed, most of the time, in boroughs of New York City, the traffic violation will be issued against the driver, and that violation will be answerable in New York State Traffic Violations Bureau. These tickets will be yellow, not pink.
Even if the summons is not dismissed, when you have a lawyer handling the matter, at the very least, you will get a drastic reduction in the amount of the fine.
