On March 22, two New York men were taken into police custody and charged with multiple offenses after authorities observed marijuana in their vehicle. They were ultimately charged with operating a motor vehicle while under the influence of drugs in addition to numerous other offenses.

Authorities said they observed a black vehicle that was traveling north onSprain Brook Parkway in Greenburgh that was failing to stay in a single lane. After the vehicle was stopped, a trooper reported that the passenger passed a bag of what appeared to be marijuana to the driver. The driver was then observed trying to put bags of marijuana into the crevice between the driver seat and the center console.

The trooper asked the driver to give him the pot from the passenger side window before going over the driver side of the vehicle. At this point, the trooper stated that the driver threw the marijuana out of the window and then took off, almost hitting him. The passenger, who had been asked to leave the vehicle while talking the trooper, then fled on foot. The driver ultimately crashed the car into a cement barrier and then fled. Both were eventually located and taken into custody.

People who have been charged with possession of marijuana could face mandatory rehab, fines and potentially even a jail sentence. However, the punishments can be even more severe if there are aggravating factors. A criminal law attorney may defend against the charges especially if the authorities did not have probable cause for pulling the vehicle over or if the evidence was tampered with.
