Traffic stop leads to drug, other charges for New York man

On May 22, news sources in New York reported that a man was taken into custody on multiple charges following a traffic stop in Ulster County. According to state police, the 19-year-old resident of West Hempstead was in possession of more than a pound of marijuana when the incident occurred. He is being held at the Ulster County Jail on $40,000 bond.

The charged man was allegedly speeding when he was pulled over by officers on Interstate 87. He is now facing a number of felony and misdemeanor charges, including second-degree possession of a forged instrument, second-degree criminal possession of marijuana and fifth-degree criminal possession of marijuana. The man was also cited for mulitple traffic and vehicle violations.

After being processed at the Newburgh barracks, the Long Island man was arraigned in the Town of Plattekill Court. Preliminary reports indicate that a return court date has not yet been scheduled. The man remains in custody in lieu of $20,000 bail.

New York residents may be aware that penalties for marijuana possession in this state may be severe. A criminal defense attorney could work to mitigate these penalties or possibly achieve a dismissal of the charges. Police must adhere to protocols when conducting an investigation. If the attorney is able to determine that the client’s constitutional rights were violated during the search that led to the seizure of the drugs, it may be possible to have the evidence declared inadmissible, which in some cases could lead to a dismissal. In other cases, the attorney might seek to negotiate a plea agreement with the prosecutor.
