Couple faces drunk driving charges

In New York, a couple was taken into custody separately for DUI after one raised suspicion when he arrived at the police station to pick up the other. Initially, a 25-year-old woman was pulled over because she did not have brake lights.

Police suspected she was intoxicated, so they administered field sobriety tests and a Breathalyzer. The woman performed poorly on field sobriety tests and blew .11 on the breath test.

Her boyfriend then came to pick her up after she was detained. However, police thought that he appeared to be intoxicated as well. Therefore, they also gave him field sobriety and Breathalyzer tests. The man performed poorly on the first and blew a .08 on the latter. As a result, he was taken into custody as well. A third person who was not intoxicated then came to pick the couple up.

Whether it is a first time offense or a person has faced drunk driving charges before, these types of charges can be serious. They can have implications for a person’s career and education if a conviction is obtained. Penalties may include fines, license suspension, jail time, and having an ignition interlock device installed on the car. However, a person who is charged with driving under the influence should keep in mind that charges are not the same thing as a conviction and that having a criminal defense attorney to develop a strategy to combat them may be advisable. For example, a Breathalyzer test might have been improperly administered, or the traffic stop itself may have been made without the required probable cause.
